Terms of Service (CGU) — Warmup

1. Acceptance of terms

By downloading, installing, or using Warmup (“the App,” “we,” “us”), you agree to these Terms of Service. If you do not agree, do not use the App. These terms are governed by [FRENCH LAW / jurisdiction — confirm], and any dispute will be handled by the courts of [JURISDICTION].

2. Description of the service

Warmup provides motivational quotes and affirmations personalized to your sport(s) and training schedule, delivered via push notifications and in-app content, with an optional premium subscription unlocking additional features (see Section 4).

3. Eligibility

[Tied to the age-gate open question flagged in Privacy_Policy.md — recommend stating a minimum age here once that onboarding gap is resolved, e.g.:] You must be at least 16 years old to use Warmup, or the applicable age of digital consent in your jurisdiction if different.

4. Subscriptions and billing — Apple-required disclosures

This section exists specifically to satisfy Apple App Store Review Guideline 3.1.2 (auto-renewable subscription disclosure requirements). Do not remove or soften this section without checking current App Store guidelines first.

• What’s included: Warmup Premium unlocks unlimited sports, premium quote categories (Competition Mindset, Resilience & Comeback, Discipline & Consistency, Recovery & Rest), tone personalization, precise reminder scheduling, streak freeze, enhanced widget styles, and watermark-free sharing.
• Pricing: Monthly subscription at €9.99/month, or Annual subscription at €49.99/year (equivalent to approximately €4.17/month).
• Free trial: New subscribers get a 7-day free trial. If you do not cancel before the trial ends, you will be automatically charged the subscription price for the plan you selected.
• Trial-ending reminder: We will send you a notification approximately 24 hours before your trial converts to a paid subscription, provided you have notifications enabled. This is a courtesy and not a substitute for reviewing your subscription status yourself.
• Auto-renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price you originally agreed to (subject to any price changes we communicate in advance per Apple’s requirements).
• How to cancel: You can manage or cancel your subscription at any time via your Apple ID account settings (Settings → [Your Name] → Subscriptions on your iPhone). Cancelling stops future renewals but does not refund the current billing period. Warmup itself cannot cancel or refund a subscription on your behalf — all billing is handled by Apple.
• Refunds: Refund requests are handled by Apple, not Warmup, per Apple’s own refund policy.
• Price changes: If we change subscription pricing, existing subscribers will be notified in advance per Apple’s requirements, and continued use after the change constitutes acceptance of the new price.

5. Acceptable use

You agree not to: reverse-engineer or attempt to extract the App’s source code beyond what’s permitted by law; use the App for any unlawful purpose; attempt to disrupt or overload our servers; share your device’s access in a way that circumvents the subscription model.

6. Content and intellectual property

All quotes, illustrations, branding, and app design are owned by JPC COMPANY or licensed to us, except where a quote is attributed to a public figure or public-domain source. You may not redistribute or resell App content commercially. You may share quote images generated by the App for personal, non-commercial use (e.g. social media), which is in fact an intended feature.

8. Disclaimers

Warmup is a motivational content app, not a medical, psychological, or professional coaching service. Nothing in the App constitutes professional advice. Use of the App to support your training is at your own discretion and risk. We make no guarantee about training outcomes, streaks, or any specific result from using the App.

9. Limitation of liability

To the maximum extent permitted by law, JPC COMPANY is not liable for any indirect, incidental, or consequential damages arising from your use of the App. Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim, or [X amount] if you’re on the free tier.

[Note: limitation-of-liability clauses have real enforceability limits under French/EU consumer protection law — a lawyer should review this section specifically, since some blanket disclaimers are unenforceable against consumers in the EU.]

10. Termination

We may suspend or terminate your access to the App if you violate these terms. You may stop using the App and delete your data at any time via the in-app deletion feature.

11. Changes to these terms

We may update these terms from time to time. Material changes will be communicated in-app. Continued use after a change constitutes acceptance.
